Use of the Website, mobile applications and other online products and services of Enerpoint S.A. de C.V.

Please read these terms of service carefully. By accessing or using the service, you agree to comply with the conditions described here and all terms incorporated by reference.

If you do not agree with these terms, do not use the services.

These Terms and Conditions of Service (“terms”) apply to your access to and use of the website, mobile applications and other online products and services (collectively, the “services”) that Enerpoint S.A. de C.V. offers to its customers. These terms do not alter the terms and conditions of any other agreement you may have with Enerpoint S.A. de C.V. for products, services or otherwise.

Enerpoint S.A. de C.V. reserves the right to change or modify these terms and conditions, or any policy or guideline of the services, at any time and at its sole discretion. Notice will be given by posting the revised terms on the services and updating the “last revised” date at the top of the “Terms and Conditions”, or by other means of notification the company may determine at its sole discretion. Using a particular form of notice in some cases does not oblige us to use the same form in other cases. Any change or modification will take effect immediately upon posting of the revisions on the services, and you waive any right you may have to receive specific notice of such changes or modifications. Your use of these services will confirm your acceptance of such changes or modifications, so you should review the applicable terms and policies frequently to understand the conditions that apply to your use of the services. The most current version of the “Terms and Conditions” can be found in the website footer. If you do not accept the modified terms, you must stop using the services.

You must be at least 18 years old to access or use the services and must not be legally incapacitated (you must have full legal capacity to enter into contracts). By registering to use the services, you represent and warrant that you are over 18, that you are not registering on behalf of a third party, and that you have not previously been suspended or removed from the services. You represent and warrant that you will not use the services if the laws of Mexico prohibit you from doing so under these terms.

For the purpose of purchasing equipment and services offered by Enerpoint S.A. de C.V., all account information is handled confidentially and transparently for Customers. Enerpoint S.A. de C.V. uses third-party services to provide payment services (e.g. card processing, payment reference generation and related services). By using any or all of these services, you agree to be bound by their terms and conditions of use.

You acknowledge and agree that any dispute you may have regarding payments and the receipt of transfers will be resolved exclusively between you and your bank, and that Enerpoint S.A. de C.V. is not responsible for any payment or transfer transactions, including, without limitation, any personal or payment information you provide.

Enerpoint S.A. de C.V. reserves the right to modify or discontinue, temporarily or permanently, the services or any feature or part of them without prior notice. You agree that Enerpoint S.A. de C.V. will not be liable for any modification, suspension or interruption of the services or any part of them.

All items included in our quotes must be reviewed and approved by the customer. Once a quote is approved, ENERPOINT SA. DE CV. is not responsible for any omissions, errors and/or missing items in it.

No refunds, exchanges or returns will be accepted. In exceptional cases, Enerpoint will evaluate the situation and make the decision it considers most appropriate under its internal policies, always ensuring a clear and secure process.

Quotes are issued in USD at the exchange rate of the payment date.

Quotes issued by Enerpoint SA. De CV are valid for 10 business days, with prices free on board (FOB).

Use the order number shown on our quotes as the bank payment reference.

Prices and products in quotes are subject to change without notice.

Once the goods are invoiced, the material must be shipped or picked up by the customer within 5 business days; otherwise a fee of 2% of the invoice value will be charged for inventory control and handling for each day after that date.

Control and handling of shipments through a carrier are the carrier's responsibility; therefore ENERPOINT SA. DE CV. is not responsible for delivery times or the handling of the goods, and if the affected party does not

The customer must pick up the purchased material no later than 30 (thirty) calendar days after the invoice date. If the customer does not pick up the material within that period, Enerpoint S.A. de C.V. is not responsible for any damage, deterioration or even loss of the material.

For purchases made through the website with online payment, goods will be delivered according to the delivery method selected by the Customer when placing the order (pickup at a branch or shipping to the address provided). Goods will only be delivered once the corresponding payment has been duly authorized, processed and credited to Enerpoint S.A. de C.V. Once the payment is credited, Enerpoint S.A de C.V must deliver the goods within the next 24 business hours.  If the payment is declined, remains pending authorization or is not credited, Enerpoint S.A. de C.V. may suspend delivery of the goods until the situation is resolved.

If the Customer does not pick up or receive the goods within a maximum of 60 (sixty) calendar days from the date Enerpoint S.A. de C.V. notifies that the goods are available for delivery, Enerpoint S.A. de C.V. may consider that the Customer has abandoned the goods for storage and administration purposes. The Customer expressly releases Enerpoint S.A. de C.V. from any liability arising from failure to pick up or receive the goods on time and agrees that, once that period has elapsed, Enerpoint S.A. de C.V. may dispose of the goods in accordance with its internal policies and applicable law, including storing, relocating or disposing of them or taking any other appropriate measure.

I confirm that I have read and understood the payment Terms and Conditions of Enerpoint S.A. de C.V., which are published on the website www.enerpoint.mx. I certify that I have carried out and will continue to carry out my activities in accordance with the standards set out in the payment Terms and Conditions, and we reaffirm our commitment to legal compliance and to upholding the highest standards of business ethics. I understand that any deviation from the Terms and Conditions described above will be cause for termination of any agreement and/or negotiation with Enerpoint S.A. de C.V.
